Requirements for the Green Card: EB-5

You may be eligible for Green Card through investment by having invested or be in the process of investing the required amount of capital in a new commercial enterprise in the U.S. The investment must benefit the U.S. economy and create ten of full-time jobs for qualified persons within the U.S.


    Creating a New Commercial Enterprise


You may create a new commercial enterprise by:

—Creating an original business

—Purchasing an existing business and simultaneously or subsequently restructuring or reorganizing the business such that a new commercial enterprise results

—Expanding an existing business by 140% of the per-investment number of jobs or net worth, or retaining all existing jobs in a troubled business that has lost 20% of its net worth over the past 12-24 months





Benefit the U.S. Economy and Create Jobs

Your engagement in a new commercial enterprise must benefit the U.S. economy and:



—    Create full-time employment for not fewer than ten qualified             individuals, or

—
Maintain the number of existing employees at no less than the per-investment level for a period of at least two years, where the capital investment is being made in a "troubled business," which is a business that has been in existence for at least two years and that has lost 20 per cent of its net worth over the past 12 to 24 months.

Q. I am on an H1, and I am not able to get a Green Card through my current job. Could I be eligible for a Green Card through an Investment Visa?

A. Yes, you could be.  However, we might need to move to a different Visa status.  For example you may need to obtain a Business Visa, and then after opening the business you could obtain a Green Card. Every thing depends on your Investment. Call us to get more details so we can discuss what we could do. Sometimes we work with the Spouse on the business end.

Q. My H1 Visa is expiring soon, and I need to leave the Country. What do I do now?  I can invest money, and that is not a problem for me. Do I need to transfer funds from India or I can invest using my U.S funds?

A. You could do either. It depends on your investment.  If the investment is not a problem, then getting a Green Card should be easier for you. We can help you. It does not matter if you are in India or in the U.S.  We could do either case.

    Great. We have 3 types of models for Franchaise business. One is Kiosk, Second with 500 sqft with chair services. Third is Spa, Salon, Browtique with 2,000 sqft. For Green card any one can invest to get and also investment brings work for the family.

    There are several requirements that every applicant has to fulfill in order to get an EB-5 visa. For example, the EB-5 investor must invest in a newly established enterprise established before Nov 29th, 1990. You have to buy the business and rebuilt it into a new enterprise or you can expand the existing business in a way that its net worth increases by 40% or there is a considerable rise in the number of employees.

    The first basis of obtaining a green card is to get a family member to sponsor you for a permanent resident card. If you want to get a green card through family, you will have to have a family member who is either already a US Citizen or US permanent resident.
